Divorce can be straightforward, with no court attendance necessary. In most cases, a divorce is not complicated and with our legal help can be dealt with amicably and without difficulty. If the divorce is not challenged by either the husband or wife, it can be dealt with in as little as 4-5 months. 

A typical, uncontested divorce may consist of the following steps:

• Filing of the Divorce Petition & if necessary, a 'Statement of Arrangements'for the children
• Documents are issued by Court and posted to the 'Respondent'
• The 'Respondent' returns an 'Acknowledgement of Service' to the Court (if he/she does not then Bailiff Service, Deemed Service or other options will need to be considered)
• The 'Petitioner' completes an 'Affidavit' in support of the 'Petition' and an 'Application for Decree Nisi'
• A Judge will then consider all the divorce papers and if he/she is satisfied they will issue a 'Certificate of Entitlement to a Decree' and 'Section 41 Certificate' (confirming he/she is content with the arrangements for any children)
• 'Decree Nisi'  is granted
• Six weeks later the application can be made by the Petitioner for the 'Decree Absolute'

When couples separate often one of the biggest concerns is the resolving and finalising of financial affairs. This includes who should remain in the matrimonial home, how the assets should be divided and should maintenance be paid to either party.

Even if an amicable divorce agreement is reached, it needs to be incorporated into a formal court document known as a 'Consent Order'  which will need to be approved by a Judge otherwise either party may make future applications for financial provision at a later date. 

It is a common mistake that parties believe the divorce itself ends financial issues. Where a financial settlement cannot be reached either party can make a formal application to the court for 'financial remedy' (previously known as 'ancillary relief').  However, before doing so they must try to resolve matters via 'mediation'  unless there is a good reason not to do so.
