Mediation

As a specialist part of our service to the Business Community, Harrison Clark offers a comprehensive Mediation Service.

Mediation is a confidential process where parties to any type of dispute use an independent individual to assist in negotiations between them to help them to resolve the dispute.

The advantages of Mediation

  • its estimated success rate exceeds 90%;

  • it can take place before or after Court proceedings have started;

  • it can save valuable management time and the substantial costs of Court proceedings;

    • future business relationships can be preserved or even strengthened once a dispute has been resolved;

    • the process is confidential;

    • the parties retain control of the process rather than having a decision imposed on them.

      Harrison Clark now has four Partners who are experienced Commercial Mediators. All have been trained by National Bodies (CEDR / ADR Group) and have extensive experience, both of acting as Mediators and in representing clients at mediations.

      Few other Law Firms have as many Mediators who can offer the depth of specialist knowledge that we have in resolving different types of disputes.

      Examples of the type of case that we have mediated

      • claims for engineering and hi-tech goods that were alleged to be not fit for purpose or of unsatisfactory quality;

      • claims for professional negligence involving Solicitors and other professional advisers;

      • Multi-party dispute relating to a defective airport runway and non-payment for surfacing works;

      • Party wall dispute between residential neighbours;

      • Disputes between several beneficiaries in respect of £5m estate which included business and overseas property interests;

      • Claims of equitable interests in land and business assets against farming estate with net value of £2m;

      • Dispute between neighbouring substantial landowners over easement for water supply and rights of way affecting residential development.
