Litigation

There are three litigation teams within Harrison Clark.

General Litigation

Andrew James leads the General Litigation team, comprising a team of lawyers providing an efficient and up to the minute service to clients at rates below those which regional and big city firms charge for comparable services.

Our aim is always to resolve clients’ disputes in a cost effective and sympathetic way. We not only handle Court and Arbitration proceedings but also resolve disputes through Alternative Dispute Resolution (ADR).

We believe we are the first firm in Worcestershire to establish an ADR Centre offering Adjudication and Mediation expertise.

The General Litigation department comprises a number of specialist teams, covering areas such as Construction and Engineering, Insolvency (Corporate and Individual), Professional Negligence claims, Debt Recovery and Personal Injury.

Commercial litigation

All businesses, no matter what size, will at some time face disputes. Whether in commerce, trade or manufacturing there will come a time when they find themselves in dispute with suppliers, customers, trading partners or professional advisers.

The technical demands of commercial litigation take it beyond the capabilities of most provincial law firms. Commercial clients have traditionally faced the high charges of large city practices to obtain the specialist advice and representation they need.

Harrison Clark’s commercial litigation department provides a unique service to meet the needs of commercial clients. They have a dedicated team of specialist commercial litigators providing a fast and efficient ‘big city’ service at highly competitive rates.

Resolving disputes quickly and efficiently to avoid unnecessary disruption and cost to your business, Harrison Clark lawyers are trained to pursue negotiation, mediation and arbitration. Litigation is a last resort - to be concluded swiftly and efficiently when it cannot be avoided.

Teams of specialist lawyers covering all aspects of corporate and commercial law are provided. When a problem requires a multidisciplinary approach, Harrison Clark can call on the vast experience of all their teams to achieve quick and comprehensive solutions.

The Commercial Litigation team is led by Richard Morgan, a specialist commercial litigator with over 20 years experience. Richard is a Deputy District Judge at High Court and County Court. He is assisted by Andrew Spooner, formerly head of Commercial Litigation at Martineau Johnson, Birmingham, and a fellow Deputy District Judge. Richard and Andrew are also accredited mediators, and Andrew is a member of the Association of Midlands Mediators and the Solicitors Disciplinary Tribunal.

Property Litigation

The property litigation team is headed by Andrew Cave, former head of property litigation at Challinors, solicitors, Birmingham, a member of the Property Litigators Association with 20 years experience in this field. Andrew's team deal with all aspects of commercial property litigation (lease renewal, rent reviews, dilapidations claims, forfeiture and breach of covenants) and residential property litigation for landlords of residential developments with lettings on long leases and tenancies.
